Nearly all electronic communications involve some kind of third party, whether it’s a phone company, an email scanner, or a law-enforcement data collection program. And as companies work to build newer, faster ways of interacting online, the law is still struggling to keep up.

    New York Times provides new details about NSA backdoor in crypto spec
    The paper points a finger definitively at the long-suspected Dual_EC_DRBG algorithm.

    Today, the New York Times reported that an algorithm for generating random numbers, which was adopted in 2006 by the National Institute of Standards and Technology (NIST), contains a backdoor for the NSA. The news followed a NYT report from last week, which indicated that the National Security Agency (NSA) had circumvented widely used (but then-unnamed) encryption schemes by placing backdoors in the standards that are used to implement the encryption.

    Private email service Lavabit begins legal fight against the government order that shut it down

    Last month Lavabit founder Ladar Levison raised over $100,000 to appeal a surveillance order, and his legal battle is now formally underway. Wired reports that details of the case, being contested in the Fourth Circuit Court of Appeals, are currently under seal, with Levison's opening brief set for October 3rd. Levison decided to close Lavabit, a private email service said to have been used by NSA whistleblower Edward Snowden, after fighting a legal case the founder said he could not discuss in detail.

    Had e-mail provider given up key, all users' data would have been compromised.

    Within a month, Lavabit still had not complied to the court's satisfaction—in fact he handed over pages of the key typed in 4-point font—and Levison was ordered to pay a $5,000 fine for each day he did not comply. On August 8, he shuttered Lavabit entirely, destroying the company’s servers.
